By accessing our website, using our services, or entering into any publishing arrangement with us, you agree to be legally bound by the following Terms & Conditions and Privacy Policy. This document constitutes a binding agreement between the Author (User) and Spark Venue Publishing (Publisher), governing all publishing, distribution, and related services.
Privacy Policy
At Spark Venue Publishing, we are committed to protecting the privacy of our users. We may collect personal information such as name, email address, phone number, address, manuscript details, and other publishing-related data when you interact with our website or services. This information is used to provide publishing services, process orders, communicate updates, and improve our offerings. We may also retain communication records such as emails or messages for support and reference purposes.
We do not sell or share personal information with third parties without your consent, except where required by law or necessary to complete services such as printing, distribution, or payment processing. Our website may use cookies to enhance user experience and analyze website performance. While we implement reasonable security measures to protect your data, complete security cannot be guaranteed, and users share information at their own risk.
Publishing Rights and Agreement
By entering into a publishing arrangement with Spark Venue Publishing, the Author grants the Publisher a non-exclusive right to publish, reproduce, distribute, and sell the Work in various formats, including print, digital, and other applicable media. The Author retains full ownership and copyright of the Work at all times. However, the Author agrees that the Work may not be published with any other publisher or platform until the Agreement is formally terminated, the Work is removed from all distribution platforms, and any associated ISBN obligations are resolved.
The Publisher shall determine the format, design, and pricing of the Work in consultation with the Author, and any major changes shall require the Author’s prior approval.
ISBN and Publication Conditions
The ISBN assigned to the Work may be issued under the Publisher or the Author, depending on mutual agreement. If issued under the Publisher, it shall remain associated with the Publisher’s publishing framework and cannot be reused independently without proper termination procedures. The Author may republish the Work elsewhere only after completing the termination process and ensuring removal from all platforms.
Content Responsibility
The Author bears sole responsibility for the originality, accuracy, and legality of the content submitted for publication. Spark Venue Publishing does not review or verify the content prior to publication and does not endorse any views expressed in the Work. Any legal disputes, claims, or liabilities arising from the content shall be the sole responsibility of the Author, and the Publisher shall not be held liable in any manner.
Copyright Policy
The Author warrants that they are the sole owner of the Work and possess all necessary rights to grant publication permissions. Any use of third-party content must be properly authorized. In case of copyright registration, it shall be carried out in the Author’s name, and the Publisher may assist in the process if required. The Author will be informed once the registration process is completed; however, the copyright certificate shall be issued directly by the Copyright Office, and the time required for issuance shall depend entirely on the respective authority.
Pricing, Printing, and Royalty
The pricing of the book shall be determined mutually, ensuring that it covers the minimum printing and distribution costs. Printing cost depends on various factors including page count, book size, format, and paper quality, and may vary if specifications change. Royalty shall be calculated based on the platform of sale. For online marketplaces such as Amazon or Flipkart, royalty shall be calculated after deducting platform commission and printing cost from the MRP. For direct sales through the Publisher, a lower commission shall apply. For e-books, royalty shall depend on platform policies and may vary accordingly. Payments shall be made as per agreed timelines, and final settlement, if applicable, shall be completed within a reasonable period after termination.
Refund and Cancellation Policy
Refunds shall be governed by a clear policy. A full refund shall be applicable only if the project is cancelled before the initiation of the ISBN process or any major production work. If the process has begun, reasonable deductions may be applied based on the work completed. Once the publishing process has been completed and the Work is made available on any platform, no refund shall be provided under any circumstances. All refund-related matters shall be handled transparently and resolved through mutual discussion.
Delivery and Shipping Policy
All books are printed on demand, and delivery timelines may vary depending on location and logistics. Generally, delivery may take between 7 to 14 days. Spark Venue Publishing shall not be held responsible for delays caused by courier services, natural events, or other factors beyond its control.
Security Clause
The Publisher undertakes reasonable measures to protect the Work from unauthorized access or distribution, including the use of industry-standard systems and digital protections where applicable. However, the Author acknowledges that complete protection against unauthorized use cannot be guaranteed.
Disclaimer
All services provided by Spark Venue Publishing are offered on an “as is” basis without any warranties, express or implied. The Publisher does not guarantee sales performance, profitability, or market success of the Work, as these depend on various external factors beyond the Publisher’s control.
Third-Party Platforms
The Publisher may distribute the Work through third-party platforms such as online marketplaces and e-book providers. Spark Venue Publishing does not control these platforms and shall not be held responsible for their policies, pricing changes, delays, or technical issues. Any transactions on such platforms are solely between the user and the respective platform.
Indemnification
The Author agrees to indemnify, defend, and hold harmless Spark Venue Publishing, its employees, and affiliates from any claims, damages, losses, or legal liabilities arising from the Author’s content, actions, or breach of this Agreement.
Termination of Agreement
This Agreement shall remain in effect until terminated by either party by providing a written notice of at least 30 days. Upon termination, all rights granted to the Publisher shall revert to the Author. The Publisher shall ensure removal of the Work from all platforms within a reasonable timeframe, and any outstanding payments shall be settled within 60 days. The Author may republish the Work elsewhere only after the completion of this process.
Force Majeure
The Publisher shall not be held liable for any delay or failure in performance due to circumstances beyond its reasonable control, including but not limited to natural disasters, government restrictions, technical failures, strikes, or other unforeseen events.
Jurisdiction
Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the competent courts of Bilaspur, Chhattisgarh, India.
Complete Agreement
These Terms & Conditions constitute the entire agreement between the Author and Spark Venue Publishing and supersede all prior communications or agreements. Any amendments must be made in writing and mutually agreed upon by both parties.
Customer Orders & Refund Policy (For Buyers)
All books available on Spark Venue Publishing are printed on a Print-on-Demand (POD) basis. Therefore, once an order is placed, it is considered final and cancellations, returns, or refunds are generally not allowed. Each book is printed specifically after receiving the order.
However, if a customer receives a defective, damaged, or incorrect product, they may report the issue by emailing us with their order details. Upon verification, an appropriate resolution, such as a replacement, will be provided.
Product Quality & Content Disclaimer (For Buyers)
Spark Venue Publishing operates as an open publishing platform where authors publish their own works. Therefore, the responsibility for the content, design, and presentation of the book lies solely with the author. The Publisher does not guarantee the accuracy, quality, or claims made in any book. Customers are advised to review book details carefully before making a purchase.
